Single panel to examine complaints by Japan, Korea and EC on US steel safeguards dispute

At its meeting on 14 June 2002, the DSB agreed that the panel established on 3 June to examine EC's complaint against US steel safeguards would also examine the complaints by Japan and Korea.

DS249 & DS251: United States — Definitive safeguard measures on imports of certain steel products

The DSB agreed to accept the second-time requests for panels by Japan and Korea, and decided to refer these cases to the panel which had been established on 3 June to examine the EC complaint since all the parties concerned had requested a single panel. EC, Japan, Korea, Mexico, Turkey and Venezuela reserved their 3rd party rights.

Panel requests deferred

The US blocked the first-time requests by Switzerland (DS253) and Norway (DS254) for panels on the US steel safeguards. The EC reminded the DSB that several other Members had questioned the compatibility of the US measures with WTO rules and that they had initiated DSU proceedings concerning the same problems. The EC said that it deplored the US choice to delay the process by blocking the first-time requests for panels. The US responded by stating that on 9 occasions the EC itself had rejected first-time requests for panels. Switzerland and Norway announced that they would inscribe their requests for panels on the agenda for the next DSB meeting on 24 June 2002.
