The three cases were:

a) DS402: US — Use of zeroing in anti-dumping measures involving products from Korea
China, EU, Japan, Mexico, Thailand and Viet Nam reserved their 3rd-party rights.

b) DS404: US — Anti-dumping measures on certain shrimp from Viet Nam
EU, Japan, Korea, Mexico and Thailand reserved their 3rd-party rights.

c) DS405: EU — Anti-dumping measures on certain footwear from China
Australia, Japan, Turkey, US and Viet Nam reserved their 3rd-party rights.

Korea — Anti-dumping duties on imports of certain paper from Indonesia

This item was on the agenda at the request of Indonesia, and relates to dispute DS312.

Indonesia recalled that following the ruling of the Article 21.5 compliance panel (WT/DS312/RW) in September 2007 that Korea's anti-dumping remained inconsistent, Indonesia could have requested the right to retaliate but decided not to do so in a spirit of goodwill and cooperation. Indonesia maintained that as a matter of law it retained the right to request authorization to retaliate.

According to Indonesia, Korea had maintained a WTO-inconsistent measure for 6.5 years, and had recently initiated a sunset review of the measure. Indonesia considered that, given that the measure had twice been found to be WTO-inconsistent, Korea should terminate the current sunset review and allow the measure to expire. Indonesia concluded that it would have no choice but to assert its rights under the Anti-Dumping Agreement and the Dispute Settlement Understanding in the event that Korea did not allow the WTO-inconsistent measure to expire.

Korea responded by expressing its disappointment at Indonesia's statement. Korea said that Indonesia was aware of the additional steps Korea had taken to fully correct the problems identified in the compliance panel report after it had been adopted by the DSB on 22 October 2007. Korea confirmed that all the DSB recommendations had been implemented and would welcome any opportunity to discuss its implementation with Indonesia.
