Complaint by Brazil

On 4 April 2016, Brazil requested consultations with Thailand regarding the alleged subsidies provided by Thailand to the sugar sector.

Brazil claims that the measures are inconsistent with:

  • Articles 3.2, 3.3, 6.3, 8, 9.1 and 10.1 of the Agreement on Agriculture; and

  • Articles 3.1(a), 3.2, 5(c) and 6.3 of the SCM Agreement.

On 15 April 2016, the European Union requested to join the consultations. On 18 April 2016, Guatemala requested to join the consultations.

Mutually Agreed Solution

On 6 March 2024, the parties notified to the DSB that they had reached a mutually agreed solution in accordance with Article 3.6 of the DSU. The mutually agreed solution stated that, in December 2022, as a result of a reform process of its domestic sugar regime, Thailand adopted certain regulatory modifications and amended the Sugarcane and Granulated Sugar Act B.E. 2527.
