Report of the Government of the United States

on the Trade-Related Provisions of the

Caribbean Basin Economic Recovery Act of 1983

for the Years 1993 and 1994

 

Introduction

On February 15, 1985, the Contracting Parties to the General Agreement on Tariffs and Trade (GATT) decided, inter alia, to waive until September 30, 1995, the provisions of paragraph 1 of Article 1 of the General Agreement, "to the extent necessary to permit the Government of the United States to provide duty-free treatment to the eligible imports of Caribbean Basin countries benefitting from the provisions of the [Caribbean Basin Economic Recover] Act, without being required to extend the same duty-free treatment to like products of any other contracting party." In accordance with paragraph 7 of that Decision, the United States is providing its report to the GATT Contracting Parties on the U.S. Government`s implementation of the trade-related provisions of the Caribbean Basin Economic Recovery Act of 1983 (CBERA), more commonly known as the Caribbean Basin Initiative (CBI). This report includes data for calendar years 1993 and 1994.

Duty-free Treatment under the CBERA

Title II, section 211 of the CBERA allows the President of the United States to eliminate duties on all products, with certain exceptions, from those Caribbean countries that he designates as beneficiary countries. Presently, there are 24 countries which are eligible to receive the benefits of the duty-free provisions of the CBERA. The most recent designation, for Nicaragua, was effective November 13, 1990. The following 20 countries were designated on January 1, 1984: Antigua and Barbuda, Barbados, Belize, British Virgin Islands, Costa Rica, Dominica, Dominican Republic, El Salvador, Grenada, Guatemala, Haiti, Honduras, Jamaica, Montserrat, Netherlands Antilles, Panama, St. Christopher-Nevis, St. Lucia, St. Vincent and the Grenadines, and Trinidad and Tobago. The Bahamas was designated a CBERA beneficiary country on March 14, 1985. On April 11, 1986, Aruba was designated a CBERA beneficiary retroactive to January 1, 1986, upon becoming independent of the Netherlands Antilles. Guyana was designated a CBERA beneficiary effective on November 24, 1988. Panama's beneficiary status under the CBERA was suspended on April 9, 1988, making it the first country to lose its designated status. Panama's benefits were restored effective March 17, 1990.

On August 20, 1990, President Bush signed the Caribbean Basin Economic Recovery Expansion Act of 1990 (CBEREA). The principal change to the CBERA (of 1983) was to delete the termination date of September 30, 1995. The CBI is now a permanent program. GATT document L/7304, dated November 10, 1993, discusses in greater detail the nature of other technical modifications made by the CBEREA.

CBI Performance

The tremendous expansion in nontraditional exports from CBI beneficiary countries since the inauguration of the CBI program has greatly cushioned the declines in traditional exports, primarily petroleum, from the region. On a region-wide basis, this export diversification has led to a more balanced production and export base and has resulted in a reduction in the region's vulnerability to fluctuations in markets for traditional products.

Total CBI country exports to the United States, excluding petroleum, increased by more than 100 percent between 1983, the year prior to the implementation of the CBI, and 1994. However, the first few years of the CBI program coincided with plummeting petroleum prices. U.S. petroleum imports from the region's primary petroleum exporters, Aruba, Bahamas, Netherlands Antilles, and Trinidad and Tobago, fell dramatically, resulting in a significant drop in total CBI exports to the United States during 1983-85. Largely because of this decline, the region's total exports to the United States in 1988 were 30 percent below their 1983 level. However, total CBI exports have since increased by 56 percent, and were 8 percent above 1983 levels in 1994.

Since 1988, however, significant nontraditional export growth was responsible for 85 percent of the increase in the region's total exports to the United States. In 1994, nontraditional exports constituted 78 percent of the region's total exports to the United States, compared with only 22 percent in 1983. These new exports include: apparel products, seafood, footwear parts, jewelry, medical instruments, electronic apparatus, and fresh and processed fruits and vegetables.

Apparel and textile exports represented approximately 50 percent of the region's nontraditional exports in 1994. While apparel products are excluded from the CBI's duty-free access to the United States, the Guaranteed Access Levels (GAL) program allows guaranteed quota access for countries negotiating such agreements with the United States for apparel products made from U.S. formed and cut fabric. Over three-fourths of the regions apparel exports are exported to the United States from CBI countries that have negotiated GAL agreements.

Statistical annexes are provided to present a detailed description of the trade aspects of the CBI program, focussing primarily on the period 1993-94. Detailed information for previous years were provided in the following documents: GATT document L/6146, dated April 3, 1987, provides data for the years 1982-86; GATT document L/6773, dated December 11, 1990, provides data for the years 1987-89; GATT document L/7304, dated November 10, 1993, provides data for the years 1990-1992.

 

Annex 1 includes a list of the beneficiaries ranked according to the value of U.S. imports entered under the CBERA provisions.

Annex 2 contains a list of the leading products, ranked by value, entered under the CBERA duty-free provisions in 1989.

Annex 3 contains a table showing the U.S. trade balance with each of the CBERA beneficiaries and for all beneficiaries as a whole.

Annex 4 contains data showing U.S. imports of the top 35 products from each beneficiary and from all of the beneficiaries combined.
