Complaint by Brazil

On 5 August 2025, Brazil requested consultations with the United States with respect to measures that imposed a 10% ad valorem duty on goods originating in Brazil and a 40% additional ad valorem duty on certain products of Brazilian origin, as well as any further tariff measures.

Brazil claimed that the challenged measures appear to be inconsistent with:

  • Articles I:1, II:1(a), and II:1(b) of the GATT 1994;
  • Articles 23.1 and 23.2(a) of the DSU.

On 15 August 2025, the United States requested that the Chair of the DSB circulate to Members a communication where it indicated that the United States accepted Brazil's request to enter into consultations, without prejudice to the United States' views that the actions cited by Brazil were issues of national security not susceptible to review or capable of resolution by WTO dispute settlement and that certain items in Brazil's request for consultations did not constitute a “measure” within the meaning of Article 4 of the DSU.
