Dear Participant,

The next meeting of the Negotiating Group on Trade-Related Aspects of Intellectual Property Rights, Including Trade in Counterfeit Goods, has been called, as agreed, for 17, 18 and 21 October 1988. In order to avoid excessive overlap with other Negotiating Groups, the Group is likely to be limited to the mornings of the 17 and 21 October and all day 18 October.

You will recall that at its last meeting the Group devoted virtually all its time to item A of the agenda. Accordingly, I indicated my intention to take up item B, Trade in Counterfeit Goods, at the forthcoming meeting no later than at the beginning of the morning session on 18 October, whatever the position reached in discussion under item A. Without intending to propose any rigid structuring of the discussion under item B, I would draw your attention to the issues referred to in Part II of the secretariat compilation, MTN.GNG/NG11/W/23. Annex I of my letter of 11 August 1988 elaborates on the same issues and poses specific questions. Some participants chose to present at the Group's last meeting detailed responses to these questions under agenda item A. It would help the Group to obtain a fuller and more balanced picture if it could hear the views of as many participants as possible on these questions in relation to trade in counterfeit goods.

In the afternoon of 18 October I would plan to seek from participants their views on points for inclusion in my report to the GNG in preparation for the Montreal Ministerial Meeting. The Group will have an opportunity to come back to this matter at the end of the week, on 21 October.

In regard to Annex II of my letter of 11 August 1988, concerning relevant GATT provisions, I will attempt, if time allows for sufficient consultation with participants in advance, to have available for the Group's next meeting a revised text that I would hope would be widely acceptable.
