AGREEMENT ON IMPLEMENTATION OF ARTICLE VI

OF THE GENERAL AGREEMENT ON TARIFFS AND TRADE

Notice of Withdrawal

 

With reference to the acceptance by Spain of the above-mentioned Agreement, I have the honour to inform you that on 8 November 1993 I received the following communication from the Government of Spain.

On 9 May 1980, Spain acceded, subject to ratification, to the Agreement on Implementation of Article VI (Anti-Dumping Code); the accession was ratified on 18 June 1981 and came into effect on 19 July of that year.

On the other hand, with effect from 1 January 1986, Spain became a full Member State of the European Communities. Since the European Economic Community is a party to the above-mentioned Agreement of 12 April 1979 and the Protocol thereto, there is no reason for Spain to continue in addition to be a party to that Agreement in an individual capacity.

Consequently, in accordance with the provisions of Article 16:9 of the Agreement on Implementation of Article VI, I wish to inform you that Spain is withdrawing from the above-mentioned Agreement, thus ending the legal anomaly that has existed since 1986.

As explained above, this notice of withdrawal is prompted by reasons of a legal and formal nature, and in no way affects my country's participation in the above-mentioned Agreement and the Protocol thereto, so that as from the date on which the withdrawal takes effect, Spain's participation will be not in an individual capacity but as a Member State of the European Economic Community, which is a party to that Agreement.

 

 

 

In accordance with paragraph 9 of Article 16 of the Agreement, the withdrawal shall take effect on 7 January 1994.

This notification is furnished pursuant to paragraph 12 of Article 16 of the Agreement.
