Complaint by Viet Nam

On 22 February 2018, Viet Nam requested consultations with the United States concerning certain measures affecting the importation into the United States of pangasius seafood products from Viet Nam, purportedly because of sanitary and phytosanitary concerns.

Viet Nam claimed that the measures appear to be inconsistent with:

  • Articles 2.2, 2.3, 4.1, 5.1, 5.3, 5.6, 8 and Annex C(1)(a) of the SPS Agreement; and

  • Articles I:1 and XI:1 of the GATT 1994.

On 8 March 2018, China requested to join the consultations.
