DS442: European Union — Anti-dumping Measures on Imports of Certain Fatty Alcohols from Indonesia

Pursuant to the second request from Indonesia, the Dispute Settlement Body (DSB) established a panel, with standard terms of reference, to examine the dispute “EU — Anti-Dumping Measures on Imports of Certain Fatty Alcohols from Indonesia”. India, Korea and the United States reserved their third-party rights to participate in the panel's proceedings.

DS453: Argentina — Measures Relating to Trade in Goods and Services

Pursuant to the second request from Panama, the DSB established a panel, with standard terms of reference, to examine the dispute “Argentina — Measures Relating to Trade in Goods and Services”.  Australia, China, Ecuador, European Union, Guatemala, Honduras, India and the United States reserved their third-party rights to participate in the panel's proceedings.

DS457: Peru — Additional Duty on Imports of Certain Agricultural Products

Following Peru's objection, the DSB deferred the establishment of a panel to examine Guatemala's complaint in the dispute “Peru — Additional Duty on Imports of Certain Agricultural Products”.

DS176, DS184, DS160, DS404, DS406, DS381: The United States presented status reports on the following disputes: “US — Section 211 Omnibus Appropriations Act of 1998”; “US — Anti-Dumping Measures on Certain Hot-Rolled Steel Products from Japan”; “US — Section 110(5) of the US Copyright Act”; “US — Anti-Dumping Measures on Certain Shrimp from Viet Nam”; “US — Measures Affecting the Production and Sale of Clove Cigarettes”; and “US — Measures Concerning the Importation, Marketing and Sale of Tuna and Tuna Products”.

DS291: The European Union provided a status report on the dispute “EC — Measures Affecting the Approval and Marketing of Biotech Products”.

DS371: Thailand presented a status report on the dispute “Thailand — Customs and Fiscal Measures on Cigarettes from the Philippines”.

DS413: China presented a status report on the dispute “China — Certain Measures Affecting Electronic Payment Services”.

DS412, DS426: Pursuant to Article 21.3 of the Dispute Settlement Understanding, Canada informed the DSB of its intention to implement the DSB's recommendations and rulings in the disputes “Canada — Certain Measures Affecting the Renewable Energy Generation Sector” and “Canada — Measures Relating to the Feed-In Tariff Program” in a manner that respects its WTO obligations.

DS217: The European Union and Japan made statements concerning the dispute “US — Continued Dumping and Subsidy Offset Act of 2000”.

DS285: Saint Lucia, speaking on behalf of Antigua and Barbuda, made a statement regarding the dispute “US — Measures Affecting the Cross-Border Supply of Gambling and Betting Services”.

DS384, DS386: United States — Certain country of origin labelling (COOL) requirements

Canada and Mexico made statements regarding the dispute “US — Certain Country of Origin Labelling (COOL) Requirements”.

 

Panellists

The DSB approved the proposed nominations, contained in WT/DSB/W/505, for inclusion in the indicative list of governmental and non-governmental panellists.

 

Other business

Under “Other business”, the Chairman made statements on three Appellate Body matters:

  • Selection process — the Chairman informed WTO members that a nomination had been received from Kenya and had been circulated to all members. He recalled that while the nomination process was open until 30 August 2013, delegations were encouraged to use best efforts to submit nominations by 31 July 2013, as per the DSB decision.
     
  • Reappointment — the Chairman reported that he had started to consult on the possible reappointment of Mr Van den Bossche and invited delegations with views on this to contact him.
     
  • Appellate Body Annual Report and workload (JOB/AB/1) — the Chairman said that some delegations had conveyed their views with regard to the implications of the Annual Report on the workload of the Appellate Body. He invited members to share any ideas/reflections they had and he would report back to all members, in line with the spirit of transparency and inclusiveness.
