According to these statistics, between 1 January 1995 and 12 November 2008,
a total of 168 safeguard investigations were initiated, and a total of 89
safeguard measures were imposed.
The number of safeguard investigations newly initiated during the most
recent period, 1 January — 12 November 2008, was five. The number of new
initiations of safeguard investigations peaked in 2002 at 34, and the
figures have been generally declining.
The member notifying the largest number of new initiations since 1995 is
India, with 15 initiations. Turkey is next with 14 initiations, and then
Jordan (12 initiations) and Chile (11 initiations). The five investigations
initiated during the most recent period (1 January — 12 November 2008) were
from Brazil, Egypt, Indonesia, the Philippines and Turkey.
Concerning the application of final safeguard measures, during the period 1
January — 12 November 2008, five new measures were imposed. The number of
final measures imposed peaked in 2003 at 15, and the figures have
subsequently stayed relatively low. The six new measures imposed during the
most recent period (1 January- 12 November 2008) were those by Turkey (four
measures), Egypt and Ukraine.
The sectors (i.e. single Harmonized System sections) most frequently subject
to the imposition of safeguard measures since 1995 are the following:
chemical products (18 impositions), foodstuffs (11 impositions), and base
metals and articles of base metal (11 impositions). There have been
approximately 25 measures imposed on agricultural products (i.e. HS sections
I — IV) during the same period.
Pursuant to Article 2.2 of the Agreement on Safeguards, safeguard measures
are applied irrespective of the source of the imported product, with the
exception of imports originating in developing country members excluded
pursuant to Article 9.1 of the Agreement on Safeguards.
The data reported above are based on the notifications made by members in
accordance with Article 12.1 of the Agreement on Safeguards, and does not
include notifications of measures taken in accordance with Article 5 of the
Agreement on Agriculture or Section 16 of the Protocol on the Accession of
the People's Republic of China.
