4.8 Invocation of Article XIII of the WTO

Article XIII of the WTO Agreement provides that the WTO Agreement and the Multilateral Trade Agreements annexed to it “shall not apply as between any Member and any other Member if either of the Members, at the time either becomes a Member, does not consent to such application” if they notify the General Council/Ministerial Conference before its approval of the agreement on the terms of accession.

Article XIII has been invoked eight times. Five invocations have been withdrawn99 and only three are still maintained.100
